Introduction

I run a brand management law firm, as opposed to many online companies that operate a ‘registration service’, that focuses on a volume business. Rather, I provide individualized attention to each client. As such, I customize engagements for each client, rather than some of the one size fits all options that are common on the internet. My litigation, infringement, and dispute resolution work instills in me the need to provide clients with the confidence that their business, trademark, and copyright filings will be successful. In my opinion, the most important part of an attorney client relationship is feeling comfortable with both the information being provided and the attorney providing it. Each legal matter is unique, and thus a specific strategy tailored to the needs and budget of a project should be drafted. I customize all client engagements and do not advertise one-size-fits-all plans or pricing. I typically complete most trademark and copyright registration matters on a flat-fee basis.

What education and/or training do you have that relates to your work?

Prior to becoming an attorney, I spent over ten years in sales, marketing, and business development. My experiences working with startups and small businesses provided me with first hand insight into the challenges that entrepreneurs face.

What advice would you give a customer looking to hire a provider in your area of work?

Determine if an attorney is the right fit for you. Are you looking to get 'the best deal' or seeking a trademark attorney with a proven track record? Intellectual property protection is an investment in your brand, and your business. Registration of a trademark is like an insurance policy, you hope to only need proof of it for ownership and licensing purposes. When it turns out that you need to use that 'insurance policy', you want to be able to rely on having proper coverage, and that the legal counsel you received from an attorney, perhaps years earlier, was sound advice. Are you talking to a brand attorney, or a volume registration service? Is the attorney willing to take the time to get to know you, and the needs of your business? Do they ask you questions, or only answer yours? Is the attorney genuinely interested in helping you with the best legal strategy, or in 'making the sale'?

What specific intellectual property needs trademark and/or copyright protection? Brand names, logos, slogans, tag lines. Who owns or will own the intellectual property? Have you already set up an LLC or corporation to own the trademarks or copyrights? Is your intellectual property eligible for registration? Have you determined whether your trademark is descriptive, and therefore not allowed registration on the principal register of the USPTO?
