Mr. Schatten took over a large personal injury case after a large TV advertising firm had terminated the client. The firm had terminated the client because they had discovered she had settled her case for $ 200 just 10 days after the car accident. Unfortunately, she ended up with a brain bleed and being placed in ICU at the hospital three weeks after the accident. The trial court enforced the $ 200 settlement and dismissed her case. Mr. Schatten won before the Colorado Court of Appeals where the Court vacated/cancelled the settlement agreement. Following the remand of the case back to the District Court, Mr. Schatten obtained a favorable settlement for the client.

What questions should customers think through before talking to professionals about their project?

unfold fold
An accident victim should take their time hiring a personal injury lawyer. Be wary of signing a retainer agreement in the first meeting with a lawyer. Often, you want to hire a strong and well respected personal injury lawyer, litigator and trial lawyer to get a strong result for your case. And, you want to do your research. Here are some good questions to ask when screening a personal injury lawyer: 1. Who will be working with me after I sign the retainer agreement? Will it be a case manager, paralegal, associate or the owner of the law firm? 2. What contingency fee rates do you charge for pre-litigation and litigation? 3. How many personal injury cases does your firm take on a year? 4. Does your firm have high turnover for the associates at your law firm? How long have most associates been with your law firm? 5. Is your firm advertising for cases on TV, radio, billboards, etc? 6. What percentage of cases do you file lawsuit (litigation)? 7. How many jury trials have you done over the last ten (10) years? And, what were the results? 8. What sort of settlements have you obtained over the last ten (10) years? 9. Do you bring in another lawyer(s) to handle your litigation cases? And, who becomes the lead lawyer on such cases? Note: Be wary reading client reviews. Some of the best personal injury lawyers can have few client reviews. Some personal injury firms can take on hundreds to thousands of personal injury cases a year. And, some of the large TV advertising firms can spend millions of dollars a year in advertising and can have high turnover rates with associates. There are also some law firms that settle the large majority of cases in pre-litigation. In many cases, particularly large personal cases, clients often get best results going with a lawyer regularly files lawsuits and prepares cases well for jury trial. And, following litigation, the large majority of cases get then settled including at mediation. End of the day, insurance companies know which lawyers do the hard work to bring litigation and prepare for jury trial and pay settlements accordingly.
